Agency Computer Systems, Inc., including its respective affiliates and subsidiaries (hereinafter, collectively referred to as "ACS"), developed this Privacy Policy ("Policy") to explain how ACS may collect, retain, process, share and transfer Personal Data. This Policy applies to the ACS Web Site, located at acs2000.net (and any successor or related Web Site designated by ACS), as may be updated by ACS from time to time (the "ACS Site"), products and services (collectively the "Services"). This Policy does not apply to web sites, services or products that ACS does not own or control or any other web site that ACS may link.

In consideration of the foregoing premises, the following mutual covenants, and other good and valuable consideration, the receipt of which is hereby acknowledged, and intending to be bound legally hereby, the parties agree as follows

By accessing or using the Services, you agree to the terms of this Policy. If you do not agree to these terms, please do not access or use the Services. The examples described in this Policy are not exhaustive.

Web Site and Acceptable Use

If you choose to use the Services, your use and any dispute over privacy is subject to this Policy, the ACS Acceptable Use Policy and the ACS Web Site Terms of Use, including warranty disclaimers, liability limitations and use limitations.

Personal Data

For purposes of this Policy, "Personal Data" means personal information that can be associated with an identified or identifiable person. "Personal Data" can include name, postal address, telephone number, email address, payment card number, other financial account information, account number, date of birth, and government-issued credentials (e.g., driver's license number, national ID, passport, Social Security number and Taxpayer ID). Personal Data does not include information that does not identify a specific person.

ACS may collect Personal Data when you use the Services, including, but not limited to the following instances:

  • Registration and use information - When you engage in certain activities, such as opening an ACS account, ordering products, using online services, or downloading software, ACS will collect Personal Data as necessary to offer and fulfill your request. Depending on the activity, ACS may require you to provide us with your name, postal address, telephone number, email address, credit card number and other identification information. ACS may require you to provide additional Personal Data as you use the Services.
  • Participant information - When you use the Services, ACS collects Personal Data you provide ACS about the third party participants associated with any transaction.

Use of Personal Data

ACS may share your Personal Data or other information for the following reasons:

  1. ACS may share Personal Data, on your behalf, with third party member insurance agencies that are acting on your behalf for the purpose of obtaining an insurance policy rate quote.
  2. ACS may share Personal Data with other parties for ACS's business purposes or as permitted or required by law, including but not limited to:
    • if ACS needs to do so to comply with a law, legal process or regulations;
    • to law enforcement authorities or other government officials, or other third parties pursuant to a subpoena, a court order or other legal process or requirement applicable to ACS;
    • if ACS believes, in its sole discretion, that the disclosure of Personal Data is necessary or appropriate to prevent physical harm or financial loss or in connection with an investigation of suspected or actual illegal activity;
    • to investigate violations of or enforce a user agreement or other legal terms applicable to any Service;
    • to protect ACS property, its legal rights or the Services;
    • to facilitate a purchase or sale of all or part of ACS's business;
    • to help assess and manage risk and prevent fraud against ACS;
    • to credit reporting and collection agencies;
    • to companies that ACS plans to merge with or be acquired by; and
    • to support ACS's audit, compliance, and corporate governance functions.
  3. ACS may also share Personal Data and other information with your consent or direction.

ACS recognizes and appreciates the importance of responsible use of this Personal Data. If you do not want the information you provide to ACS to be used to inform you of other products and special offers from ACS, and you indicate this preference when you provide the information to ACS, ACS will honor your preference. In addition, ACS may selectively provide certain information to other companies or organizations that have products or services we think may interest you. If you do not want the information you provide to ACS to be shared with other companies, and you indicate this preference when you provide the information to ACS, ACS will honor your preference.

Personal Data Protection and Storage

ACS will maintain the confidentiality of the Personal Data that it collects. ACS does this by maintaining technical, physical, and administrative security measures designed to provide reasonable protection of Personal Data against loss, misuse, unauthorized access, disclosure, and alteration. The security measures include firewalls, data encryption, and information access authorization controls. As you are likely aware, no matter the extent of security measures taken, data breaches occasionally occur. In the event such a breach occurs, ACS will make reasonable attempts to notify you in a timely manner.

While ACS is dedicated to securing its systems and Services, you are responsible for securing and maintaining the privacy of your password(s) and account/profile registration information and verifying that the Personal Data we collect from you is accurate and current. ACS is not responsible for protecting any Personal Data that it shares with a third-party based on an account connection that you have authorized.

When you submit Personal Data to ACS, you understand and agree that ACS and trusted vendors may transfer, store, and process your customer profile (or other data you provide to us) in any of the countries in which ACS and its affiliates maintain offices, including without limitation, the United States. To this end, if you have any unique requirement that forbids location of Personal Data or other information in any country, please notify ACS at once, and do not use the ACS Site until ACS can take appropriate measures.

Cookies

ACS may use technologies like cookies and pixel tags to provide, improve, protect, and promote our Services. For example, cookies help ACS with things like remembering your username for your next visit, understanding how you are interacting with the Services, and improving them based on that information. The Help feature on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether. Additionally, you can disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-on's settings or visiting the Web site of its manufacturer. By modifying your accessibility to cookies, you may limit your ability to use the Services.

Modification and Severability

We reserve the right to make changes to this Policy and the Services at any time. By accessing or using the Services, you agree to the latest version of this Policy. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition. If you violate the Policy or authorize or help others to do so, ACS may suspend or terminate your use of the Services.

Governing Law

This Policy shall be governed by and construed in accordance with the laws of the State of Michigan, exclusive of its choice-of-law rules. Any and all disputes involving the Policy shall be heard in the State or Federal Courts sitting within Eastern (U.S. judicial) District of Michigan, and you agree and submit to the personal and exclusive jurisdiction of those Courts.
